1 Use of Your Account

• You must use a valid email address for your fivenines account.
• You must not use the Service for any illegal or abusive purposes.
• You are solely responsible for the security of your account.
• You own or have authorization to use our service from the legal owner of the URL(s) to be monitored.
• Our service shall only be used in accordance with any and all applicable laws and regulations.

2 Payment and Billing

• All paying subscriptions are billed in advance based on the selected plan and renew automatically at the end of each billing period, unless canceled.
• Your credit card will be charged on the renewal date for the upcoming billing cycle.
• Any failed payment attempts may result in the suspension or termination of your subscription.
• All fees are non-refundable unless explicitly stated otherwise in this agreement.
• You are responsible for ensuring your payment details are up-to-date to avoid service disruptions.

3 Refund Policy

You may ask for a refund by sending an email to contact@fivenines.io. The email needs to contain any information required to identify your fivenines account (GitHub username, email, etc.).

4 Cancellation and Termination

• You may at any time close your fivenines account.
• Any abuse of the Service will lead to termination of your account. fivenines reserves the right to decide what is considered abuse of the Service.

5 Intellectual Property

• The source code and the website architecture are protected by copyright. Any use of these elements is prohibited unless prior written consent is obtained.
• "fivenines" is a registered trademark. Any commercial use of the "fivenines" trademark is prohibited unless prior written consent is obtained.

6 Changes to Terms

These Terms of Service may be updated from time to time without prior notice. The current Terms of Service are always available at fivenines.io/tos.

7 Disclaimer

• The fivenines Service is provided "as is" and "as available".
• fivenines reserves the right to modify the Service from time to time, including adding and removing features.
• fivenines reserves the right to discontinue the Service at any time after a notice via email.
• fivenines reserves the right to change the prices for the Service at any time.
• fivenines gives no warranties regarding the correctness of the data collected or any potential corruption or loss of such data.

8 Limitation of Liability

• fivenines shall not be liable for any damages resulting from the use of the fivenines service.
• Any decisions or claims you make based on data from the Service are your sole responsibility.
• In no event shall fivenines's total liability exceed the amount paid by you for accessing this site.

9 Indemnification

You agree to indemnify, defend and hold harmless fivenines and its officers, directors, employees, consultants and agents from any and all third party claims, liability, damages and/or costs arising from your use of the fivenines service, your violation of the terms of use or your infringement of any intellectual property or other right of any person or entity. You agree to immediately notify fivenines of any unauthorized use of your account or any other breach of security known to you.

10 Applicable Law

This contract shall be governed by the law of France. Any dispute, controversy or claim arising out of or in connection with this contract shall be solved by a Court in France.
